TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale govern the purchase of products made through the online store www.anabelaram.eu (the "Website"), owned by ANABEL ARAM JEWELRY EUROPE S.L. ("Anabel Aram").
The applicable terms depend on the customer's place of residence, as set out below.

Placing an order through the Website implies the express and full acceptance of these Terms and Conditions of Sale in the version published at the time of purchase. If the customer does not agree with any of the provisions contained herein, they must refrain from placing orders through the Website.

SECTION A – EUROPEAN UNION (EU)

This section applies exclusively to consumers resident in the European Union.

2. PRODUCTS

Products are described as accurately as possible on the website. Images are for illustrative purposes only, and slight variations in color, tone, or finish may occur compared to the final product, inherent to the artisanal nature of the pieces. Such variations do not constitute a lack of conformity or grounds for return, provided they do not affect the essential characteristics of the item described in the product sheet.

In the event that an item is shown as available at the time the order is placed but it is later found that there is insufficient stock to fulfill it, we will notify you of this circumstance as soon as possible after order confirmation. In such cases, we will cancel the order or the affected part thereof and refund the corresponding amount.

3. PRICES AND VAT

All prices are shown in euros (EUR) and include applicable VAT, unless otherwise indicated. Shipping costs are shown separately during the purchase process.

We reserve the right to cancel any order in the event of obvious pricing errors, typographical errors, or lack of stock, even after order confirmation. In such cases, we will notify the customer within a maximum of 5 business days from the placement of the order and will refund the full amount paid within a maximum of 14 days from such notification. Cancellation on these grounds shall not entitle the customer to any compensation.

4. ORDER PROCESS AND FORMATION OF THE CONTRACT

An order placed on the website constitutes an offer to purchase by the customer. Receipt of an order confirmation email from Anabel Aram constitutes only an acknowledgment of receipt of such offer and does not imply acceptance thereof.

The sales contract is formed only when Anabel Aram sends the customer the shipment confirmation email. Until receipt of such shipment confirmation, Anabel Aram assumes no obligation to supply and may reject the purchase offer without justification, refunding all amounts paid within a maximum of 14 days.

By placing an order on the website, the customer declares that they are of legal age under the legislation of their country of residence and have sufficient legal capacity to enter into contracts. Anabel Aram reserves the right to request proof of the customer's age or identity when reasonably necessary and to cancel any order where there are reasonable indications that this requirement is not met.

Likewise, Anabel Aram reserves the right to reject or cancel orders where there are reasonable indications of fraudulent activity, identity theft, improper use of payment methods, intent for commercial resale, or where the quantities requested exceed those reasonable for a final consumer. In such cases, Anabel Aram will refund the amounts paid, without entitling the customer to any compensation.

If, after 24 hours from placing the order, you have not received the confirmation email, we recommend checking your spam folder and contacting us at euhelp@anabelaram.com. Anabel Aram shall not be responsible for delays or incidents arising from failure to receive the confirmation email due to causes beyond its control, such as spam filters, incorrect addresses, or issues with the customer's email service provider.

5. PAYMENT

Payment is made at the time the order is placed. Accepted payment methods are displayed during the purchase process and include major credit and debit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay, and any other method shown as available during checkout.

Anabel Aram reserves the right to modify the accepted payment methods at any time, without prior notice. The charge to the customer's account or payment method will be made at the time of order confirmation.

If the card issuer or payment provider rejects or fails to authorize the payment, the order will be automatically cancelled, and Anabel Aram shall assume no liability for such circumstance. Anabel Aram reserves the right not to process orders for which payment authorization has not been satisfactorily verified.

All prices are stated and invoiced in euros (EUR). If the customer's payment method is denominated in a different currency, currency conversion will be carried out by the customer's card issuer or payment provider according to their own terms and exchange rates, over which Anabel Aram has no control or responsibility.

6. DELIVERY

Products will be delivered to the address provided during the purchase process. Delivery times indicated in our Shipping Policy are estimates and are not guaranteed.

7. TRANSFER OF RISK

The risk of loss or damage to the goods shall pass to the customer at the moment when the customer, or a third party designated by the customer other than the carrier, acquires physical possession of the goods. However, if the customer arranges transport with a carrier other than the one proposed by Anabel Aram, the risk shall pass at the time the goods are delivered to the carrier designated by the customer.

If delivery cannot be made within the maximum delivery period, we will inform the consumer without delay, offering a new reasonable delivery period. If delivery does not take place within such additional period, or if the consumer does not accept the newly proposed period, the consumer shall have the right to terminate the contract, with a full refund of all amounts paid within a maximum of 14 days from the exercise of such right.

8. RIGHT OF WITHDRAWAL

EU consumers have the right to withdraw from the contract within 14 days without providing any reason. This period shall be calculated from the day on which the consumer, or a third party designated by them other than the carrier, acquires physical possession of the goods.

To exercise this right, the consumer must notify their decision by means of an unequivocal statement before the expiry of this period, using the model withdrawal form available on our Right of Withdrawal (EU) page or any other clear statement addressed to euhelp@anabelaram.com. 9. RETURNS AND REFUNDS

The conditions applicable to returns and refunds are set out in our Returns and Exchanges Policy, without prejudice to statutory withdrawal rights.

10. LEGAL GUARANTEE OF CONFORMITY

Products benefit from the legal guarantee of conformity in accordance with Directive (EU) 2019/771 and the applicable national transposing legislation in the consumer's country of residence.

Anabel Aram shall be liable for any lack of conformity of the products due to manufacturing defects sold through this Website where such lack of conformity existed at the time of delivery and becomes apparent within three years thereafter, provided it is reported within two months of becoming known. In such cases, and at the consumer's choice, once Anabel Aram has verified the issue, it may proceed with the repair or replacement of the item, provided this is possible and proportionate to the circumstances. Otherwise, the consumer may choose between a proportionate price reduction or termination of the contract. Termination shall not apply where the lack of conformity is minor.

This guarantee covers manufacturing defects and lack of conformity with the description provided on the Website. It does not cover, among others:
(a) damage caused by improper or negligent use or use contrary to the care instructions provided;
(b) improper handling;
(c) normal wear and tear resulting from regular use;
(d) alterations or repairs carried out by unauthorized third parties; or
(e) minor variations in color, tone, or finish inherent to the artisanal nature of the pieces.

Personal data is processed in accordance with our Privacy Policy.

12. ONLINE DISPUTE RESOLUTION

13. APPLICABLE LAW

These Terms and Conditions of Sale are governed by Spanish law, without prejudice to the mandatory consumer protection provisions of the consumer's country of residence within the European Union, which shall prevail over Spanish law where more favorable to the consumer.

For the resolution of any disputes arising from these Terms, the parties submit to the Courts and Tribunals of Valencia (Spain), without prejudice to the right of consumers resident in the European Union to bring proceedings before the courts of their place of domicile in accordance with Regulation (EU) No. 1215/2012 of the European Parliament and of the Council.

SECTION B – INTERNATIONAL CUSTOMERS (OUTSIDE THE EU)

This section applies to customers located outside the European Union.

1. PRICES AND TAXES

As a general rule, prices shown on the website for customers outside the European Union do not include local taxes, customs duties, or import charges of the destination country (DAP – Delivered At Place). Such charges, where applicable, shall be the sole responsibility of the recipient customer and must be paid directly to the customs authorities or the carrier upon delivery.

In destinations where Anabel Aram expressly offers DDP (Delivered Duty Paid) during the purchase process, import duties and taxes shall be included in the final price shown at checkout, and this shall be explicitly indicated prior to purchase confirmation.

We recommend that international customers consult with the customs authorities of their country regarding applicable charges before placing an order, as Anabel Aram has no control over such amounts and cannot guarantee their accuracy in advance.

2. DELIVERY AND CUSTOMS

Delivery times are estimates only and may be affected by customs clearance procedures. We are not responsible for delays caused by customs authorities.

3. TRANSFER OF RISK

The risk of loss or damage passes to the customer when the goods are delivered to the carrier.

4. RETURNS AND CANCELLATIONS

Customers located outside the European Union do not benefit from the statutory right of withdrawal established under European regulations. Returns and cancellations may be accepted only in accordance with the terms and conditions set out in our Returns and Exchanges Policy, subject to Anabel Aram's assessment on a case-by-case basis.

The foregoing is without prejudice to any mandatory rights that may apply to the customer under the consumer protection laws of their country of residence, the burden of proof of which shall lie with the customer.

5. WARRANTY

The statutory guarantees of conformity provided under European Union law do not apply to customers located outside the EU. Anabel Aram shall not assume warranty obligations beyond those that are mandatorily applicable under the laws of the customer's country of residence, the burden of proof of which shall lie with the customer.

In any event, Anabel Aram shall not be liable for claims arising from, among others:
(a) damage caused by improper or negligent use or use contrary to the care instructions provided;
(b) improper handling;
(c) normal wear and tear resulting from regular use of the item;
(d) alterations or repairs carried out by unauthorized third parties; or
(e) minor variations in color, tone, or finish inherent to the artisanal nature of the pieces.

6. APPLICABLE LAW

These Terms and Conditions of Sale for international customers are governed by Spanish law, without prejudice to any mandatory rights applicable under the consumer protection laws of the customer's country of residence.

For the resolution of any disputes arising from these Terms with customers acting as business entities or professionals, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Valencia (Spain), waiving any other jurisdiction that may apply.

For customers acting as consumers, the foregoing shall be without prejudice to the courts of competent jurisdiction applicable under the mandatory laws of their country of residence.
